Recognizing that an efficient bankruptcy system could play an important role in improving the economy and the overall development of the country, reviving businesses, and maximizing the economic value of the companies in financial distress, Bosnia and Herzegovina has implemented a profound and radical bankruptcy system reform.

These activities have been supported by USAID, reputable international experts and consulting companies. Applying the standards of the best practice in Europe and developed world, new Bankruptcy Laws were enacted in 2003. New Bankruptcy Laws provide an efficient and speedy bankruptcy procedure, foreseeing two main types of proceeding, e.g. restructuring and liquidation of companies (debtor).

Enacting of new Bankruptcy Laws in Bosnia and Herzegovina was accompanied with extensive training programs for main actors conducting the bankruptcy proceedings. Implementation of the new bankruptcy system has already delivered extremely good results, and dramatically accelerated both restructuring and liquidation proceedings, increased creditor recoveries and preserved jobs, in a variety of industries, in all regions of Bosnia and Herzegovina. In addition, the new bankruptcy system has created an array of new opportunities for both foreign and local investors, offering under extremely convenient conditions an office and production space for launching new businesses, as well as abundant opportunities for restructuring and improving of existing businesses or production programs.
